The availability of online payment functionality for each payment type is subject to technical implementation, project-specific configuration, and applicable regulatory requirements at the relevant time.
3. Relationship to Transaction DocumentsAll payments made through the website, mobile application, or payment portal are subject to these Payment Terms and the applicable transaction documents. The Company is under no obligation to accept any payment that:
• is not made in accordance with these Payment Terms or the applicable transaction documents;
• is made following termination of the applicable transaction document;
• does not correspond to a valid outstanding payment obligation.
Receipt or processing of a payment through the website, application, or payment portal shall not be deemed or construed as an acceptance of such payment, nor as a waiver of the Company’s right to reject, return, or query that payment at a later date. In the event of any conflict between these Payment Terms and the applicable transaction documents, the transaction documents shall prevail.
4. Payment Currency and PricingAll transactions are processed in UAE Dirhams (AED) unless expressly stated otherwise on the payment screen. The Company does not accept responsibility for exchange rate fluctuations or currency conversion fees applied by your bank or card issuer.
Prices, fees, and payment amounts displayed on the website, application, or payment portal are indicative only and are subject to the amounts set out in the applicable signed transaction documents. In the event of any discrepancy, the signed transaction documents shall prevail.
5. Payment ProcessingOnline payments are processed by third-party licensed payment service providers (“Payment Processors”) operating under licences issued by the Central Bank of the UAE or other competent financial regulatory authorities. The Company does not itself hold, process, or store full bank card numbers, CVV codes, or authentication credentials.
By initiating a payment, you authorise the Company and the relevant Payment Processor to charge the payment method you have provided for the amount displayed at the time of confirmation.
Payment transactions will be processed on the day the transaction is submitted, unless submitted on a weekend or non-working day, in which case processing will occur on the next working day. The Company expressly disclaims any and all liability for processing delays which may occur in any circumstance.
6. Payment SecurityAll transmission of card and payment data is encrypted using industry-standard TLS/SSL protocols. The Company does not store full card numbers, CVV codes, or PIN data.
You are responsible for ensuring that the device and network connection used for online payments are secure. The Company accepts no liability for losses arising from your use of an unsecured or compromised device or network.
Security noticeArsenal East will never ask you to make payments to a personal bank account or to an account other than the Company’s official bank account details provided in your signed transaction documents or confirmed in writing by an authorised Company representative. If you receive suspicious payment instructions, contact us immediately at info@arsenaleast.com.7. Confirmation and Receipt of PaymentPayment is not accepted and is not deemed made until the funds have cleared in the Company’s bank account. An on-screen acknowledgment or automated email notification does not constitute final confirmation of receipt of funds.
Upon receiving and verifying cleared funds, the Company will issue a formal receipt acknowledging the payment. This receipt is the authoritative record of payment for the relevant transaction.
It is your responsibility to retain all payment confirmations, receipts, and transaction records issued through the website, application, or payment portal as evidence of payment. The Company accepts no liability for your failure to maintain such records.
8. Declined and Failed PaymentsYou are responsible for ensuring that sufficient funds or available credit exist when initiating a payment. The Company is under no obligation to notify you of a declined, rejected, or failed payment.
In the event of a declined payment:
• no payment will be recorded against your transaction account until funds are received and cleared;
• your payment obligations under the applicable transaction documents remain outstanding and are not suspended, deferred, or extended by reason of the declined transaction;
• you are responsible for any additional fees or charges levied by your bank, card issuer, or Payment Processor in connection with the declined transaction.
You must notify the Company immediately at
info@arsenaleast.com in the event of any failed transaction or technical difficulties encountered when using the online payment functionality.
9. Incorrect, Unauthorised, and Fraudulent TransactionsIf any transaction is found to be incorrect, unauthorised, or fraudulent, the payment may be reversed and the relevant payment obligation shall remain outstanding. The Company reserves all rights in connection with fraudulent or unauthorised payment attempts, including the right to suspend account access and report the matter to relevant authorities.

10. Duplicate and Excess PaymentsAny duplicate or excess payment received will be adjusted against your next scheduled payment obligation under the applicable transaction documents. Where no future payment obligation exists under the applicable transaction documents, the Company will arrange for the excess to be returned to the original payer’s verified bank account within a reasonable period.
The Company accepts no liability for processing delays caused by your bank or Payment Processor in connection with any such adjustment or return.
11. Chargeback PolicyThe Company does not accept chargeback requests raised directly with card issuers or Payment Processors as a mechanism for disputing or reversing real estate transaction payments. All disputes relating to transaction payments must be submitted to the Company in writing in the first instance.
Initiating a chargeback in respect of a valid payment obligation under any transaction document- including, without limitation, a Booking Form, Reservation Agreement, SPA, or any other agreement between the buyer and the Company — may constitute a breach of the applicable transaction document and may entitle the Company to exercise its termination rights under that document, retain amounts as permitted by applicable law, and seek recovery of all costs and losses incurred in connection with the chargeback, including legal fees and Payment Processor charges.
12. Data Protection and Payment DataPersonal data collected in connection with online payments is processed in accordance with the Company’s Privacy Policy and applicable UAE data protection laws. The Company does not store full card details; these are handled solely by the licensed Payment Processor.
By making a payment, you consent to the processing of your payment-related personal data as described in the Privacy Policy.
13. Third-Party Payment ProcessorsPayments are processed by third-party Payment Processors licensed by the Central Bank of the UAE or other competent authorities. Use of the payment functionality is also subject to the Payment Processor’s own terms and conditions, which will be made available at the point of payment. The Company is not responsible for the availability, security, or performance of third-party Payment Processor systems.
14. Limitation of LiabilityTo the fullest extent permitted by applicable law, the Company shall not be liable for any loss or damage arising from:
• payment processing delays or failures caused by your bank, card issuer, or Payment Processor;
• your failure to ensure sufficient funds or credit are available;
• your failure to retain payment confirmation records;
• your use of an unsecured device or network;
• any incorrect payment details entered by you.
Nothing in these Payment Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
15. Changes to These Payment TermsWe may update these Payment Terms from time to time to reflect changes in services, payment technology, legal obligations, or operational needs. The updated version will be posted on the website and/or payment portal with a revised effective date. Continued use of the online payment functionality after such update constitutes acceptance of the revised Payment Terms.
16. Governing LawThese Payment Terms are governed by the laws of the UAE and, where applicable, the Emirate of Dubai. Any dispute arising out of or in connection with these Payment Terms shall be subject to the exclusive jurisdiction of the competent courts of the Emirate of Dubai, unless another forum is required by mandatory law or expressly agreed in writing.
