TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of the website and mobile application Arsenal operated by Arsenal East Real Estate Development L.L.C. (“Company”, “we”, “us”, or “our”). By accessing or using our website or mobile application, you agree to these Terms. If you do not agree, you must not use the website or application.
These Terms should be read together with our Privacy Policy, Cookie Policy, and Online Payment Terms, each of which is incorporated herein by reference and available on the website and mobile application.

2. Scope of ServicesThe Arsenal website and mobile application are designed to help users search for, review, reserve, and purchase real estate in the UAE. Depending on functionality available at the relevant time, the website or application may allow users to:
• browse projects, buildings, and units;
• submit booking or reservation requests;
• make online payments in accordance with the Online Payment Terms;
• track booking and transaction status;
• view payment schedules and payment history;
• access certain transaction-related documents;
• communicate with a personal manager or our representatives.

3. EligibilityYou may use the services only if you are at least 18 years old, have legal capacity to enter into binding arrangements under applicable law, and your use of the services does not violate applicable law.

4. Accounts and RegistrationCertain features require registration. You agree to provide accurate and complete information, keep your account details updated, maintain the confidentiality of your credentials, and notify us promptly of any unauthorised use of your account.
Each user may hold only one account. Use of multiple accounts by the same individual constitutes a breach of these Terms. If you have inadvertently received more than one set of login credentials, please notify us at info@arsenaleast.com immediately.
We may request additional verification, documents, or information where necessary for security, booking, transaction support, compliance, or legal purposes.
Registration or sign-in may be available via email, phone/SMS, Apple ID, Google, Facebook, X (Twitter), Emirates ID, or similar methods depending on the functionality made available.

5. Information Only; No OfferThe website and application are provided for informational, communication, booking-support, and customer service purposes. Unless expressly stated otherwise in a signed written agreement:
• content does not constitute legal, financial, tax, investment, or other professional advice;
• project descriptions, visuals, layouts, floor plans, availability, pricing, and timelines may be updated, changed, or withdrawn at any time;
• submission of an inquiry or booking request does not create a binding obligation on the Company to sell, reserve, or hold any property;
• no content constitutes a legally binding offer, representation, or guarantee.
Final transaction terms are those set out in the relevant executed transaction documents. Illustrations, renders, floor plans, and artist impressions are indicative only and may differ from the completed development.

6. Property Reservations and BookingsAny booking or reservation request is subject to our review, internal approval, document completion, compliance checks, and payment confirmation. A request submitted through the website or application is only a request unless and until formally accepted and confirmed by us in writing.
Property availability may change without notice; units shown as available may no longer be available; prices or commercial terms may be updated at any time.

7. KYC, Compliance, and Required DocumentsWhere required for booking, purchase, compliance, anti-money laundering, fraud prevention, sanctions screening, legal obligations, land registration, or banking purposes, we may collect, verify, and use personal data and supporting materials including identification details, passport or visa information, address details, KYC forms, and other due diligence documentation.
You agree that all information and documents provided must be accurate, complete, current, and lawful. We may refuse, suspend, or delay any booking, transaction step, or service if required information is missing, cannot be verified, or raises compliance concerns.

8. Mobile Application The Arsenal mobile application (“App”) may be made available for download from the Apple App Store and/or Google Play Store. By downloading or using the App, you agree to comply with the applicable terms of the relevant App Store in addition to these Terms.
The App may request access to device features including geolocation, camera, push notifications, and biometric authentication (Face ID/fingerprint), subject to your consent and device settings. You may manage or revoke App permissions at any time through your device settings; revoking certain permissions may limit App functionality.
Each user may hold only one account. We may issue App updates from time to time; we recommend keeping the App updated to the latest available version. We do not guarantee that older versions will remain functional or secure.

9. Communications and SupportWe may communicate with you through email, phone, SMS, WhatsApp, Telegram, support forms, or personal manager contact tools. We may use your contact details and transaction-related information to respond to your requests, provide support, and improve service quality. Interactions may be logged in CRM and ERP systems for service, compliance, and record-keeping purposes.

10. Acceptable UseYou agree not to use the website or application:
• unlawfully, fraudulently, or in violation of these Terms;
• to impersonate any person or entity;
• to submit false or misleading information or documents;
• to interfere with or damage the services or associated systems;
• to attempt unauthorised access to any system, account, or data;
• to introduce malware or malicious code;
• to use bots, scraping tools, or automated means to extract content without prior written consent;
• to commercially exploit any part of the services without prior written authorisation.
We may suspend, restrict, or terminate access where we reasonably believe these Terms or applicable law have been violated.

11. Intellectual PropertyAll content, software, designs, text, graphics, logos, trademarks, photographs, videos, layouts, and other materials made available through the website or application are owned by the Company, its licensors, or relevant rights holders and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable right to use the website and application solely for your personal, lawful, and non-commercial use.

12. Third-Party Services and LinksThe website and application may integrate with or link to third-party services, maps, communications platforms, authentication providers, analytics services, banking channels, payment processors, or external websites. We do not control and are not responsible for the content, availability, security, terms, or practices of such third parties. Use of third-party services is at your own risk and subject to their respective terms.

13. Transaction Information and DocumentsThe website and application may display booking status, transaction status, payment schedule, payment history, and certain documents for convenience. While we seek to keep such information reasonably current, we do not guarantee completeness or accuracy at all times. In the event of any discrepancy between information displayed and signed agreements, official records, or bank confirmations, the latter shall prevail.

14. Suspension, Restriction, and TerminationWe may suspend, restrict, or terminate your account or access to the services if we reasonably suspect fraud, misuse, unlawful conduct, breach of these Terms, inability to verify required information, or where continued access is inappropriate for legal, compliance, security, operational, or technical reasons.
Termination or deletion does not affect rights and obligations accrued before termination or obligations arising under signed transaction documents.

15. DisclaimersTo the maximum extent permitted by law, the website, application, and related services are provided on an “as is” and “as available” basis. We do not warrant that the services will be uninterrupted, secure, or error-free, or that content will always be accurate, complete, current, or suitable for your needs.

16. Limitation of LiabilityTo the fullest extent permitted by law, the Company and its affiliates, officers, employees, agents, contractors, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your use of or inability to use the services, reliance on content, technical failures, third-party failures, payment issues outside our reasonable control, or unauthorised access resulting from failure to protect your credentials.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including in respect of fraud, gross negligence, or death or personal injury caused by our negligence.

17. IndemnityYou agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, employees, representatives, contractors, and service providers from and against claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or related to your breach of these Terms, misuse of the services, violation of law or third-party rights, or false, misleading, or unlawful information or documents provided by you.

18. Changes to Services or These TermsWe may update these Terms from time to time to reflect changes in services, practices, legal obligations, or operational needs. The updated version will be posted on the website and/or made available through the application together with the revised effective date. Where changes are material, we will endeavour to provide reasonable prior notice. Continued use after such update constitutes acceptance of the revised version.
